Ownership of Intellectual Property

Unless otherwise stated, the intellectual property displayed or made available through this website is owned by or licensed to Konsilee.

This includes, without limitation:

• Product designs and design features

• Concepts, sketches, CAD files, technical drawings, prototypes and renderings

• Product photography, videos, animations, graphics and digital content

• Product descriptions, instructions, policies, website copy and marketing materials

• Packaging artwork and packaging design

• Product names, collection/bundle names, slogans and brand language

• The Konsilee name, logos and other brand identifiers

• Website graphics, visual presentation and original creative elements

These materials may be protected by copyright, registered design rights, trade mark rights, patent rights and other applicable intellectual property laws in Australia and internationally.

Product Design Protection

Konsilee’s products are developed through an extensive design and product-development process.

Certain Konsilee product designs and product features are protected by registered design rights and/or are the subject of pending design and patent applications in Australia and internationally.

These rights may protect aspects of a product’s visual appearance, including its shape, configuration, pattern and ornamentation, as well as certain functional product innovations.

The publication or sale of a Konsilee product does not grant any person or business permission to copy, reproduce, manufacture, commission, import, advertise or sell a product that infringes Konsilee’s intellectual property rights.

Trade Marks and Brand Identity

The Konsilee name, logos, product names, slogans and other distinctive brand elements are valuable assets of the Konsilee brand.

Registered and unregistered trade marks must not be used without prior written permission.

You must not use Konsilee’s brand identity in a way that:

• Suggests an affiliation, partnership, sponsorship or endorsement that does not exist

• Misleads customers about the origin of a product

• Is likely to cause confusion between Konsilee and another business

• Promotes counterfeit, copied or unauthorised products

• Damages or takes unfair advantage of Konsilee’s reputation

No Permission to Copy or Reproduce

Unless you have received Konsilee’s prior written permission, you must not:

• Copy, reproduce or imitate a protected Konsilee product design

• Manufacture or commission the manufacture of a product that infringes Konsilee’s intellectual property rights

• Use Konsilee’s CAD files, technical drawings, prototypes, renderings or other development materials

• Copy Konsilee’s photographs, videos, graphics, written content, policies or product listings

• Remove, alter or obscure any copyright, trade mark or proprietary notice

• Use Konsilee’s content or brand assets to market another product or business

• Represent another product as being manufactured, supplied, approved or endorsed by Konsilee

• Use Konsilee’s intellectual property in a way that falsely implies an association with Konsilee

Changing minor details, colours, dimensions or decorative features does not necessarily prevent a product or work from infringing existing intellectual property rights.

Retailers and Commercial Use

Konsilee products may only be represented as authorised Konsilee products where they have been obtained through Konsilee or an authorised Konsilee wholesale or distribution arrangement.

The purchase of a Konsilee product does not transfer ownership of the intellectual property embodied in the product, packaging, branding or accompanying content.

Any proposed commercial use of Konsilee’s intellectual property requires prior written approval.

Monitoring and Enforcement

Konsilee actively monitors the market for potential infringement of its product designs, trade marks, brand assets and creative content.

Where appropriate, Konsilee and/or the relevant rights holder may take steps including:

• Contacting the person or business involved

• Issuing formal legal correspondence

• Submitting intellectual property complaints or takedown notices to ecommerce platforms, online marketplaces, search engines and social media platforms

• Notifying manufacturers, suppliers, fulfilment providers, advertising platforms or payment providers

• Seeking injunctions, damages, legal costs or other remedies available under applicable law

Konsilee reserves all rights to protect and enforce its intellectual property to the fullest extent permitted by law.

Reporting Potential Infringement

If you believe a Konsilee product design, photograph, video, written work, trade mark or other brand asset has been copied or used without authorisation, please contact us through our website.

Please include:

• A link to or screenshot of the relevant product or content

• The name of the person, business or marketplace involved

• Any other information that may assist our investigation

All reports will be reviewed, but Konsilee may not be able to provide updates regarding any investigation or action taken.

Permission Requests

To request permission to use any Konsilee intellectual property, please contact us in writing and explain:

• The material you would like to use

• How and where it would be used

• Whether the proposed use is commercial

• How long you intend to use it

Permission is not granted unless and until it has been expressly confirmed by Konsilee in writing.
